Scope of application

The scope of application is all enterprises operating in the EU and all enterprises that process data using equipment located in the EU, while the scope of GDPR (2016) is extended to all enterprises that process personal information of citizens of EU member states, regardless of the citizen’s current residence within the EU.

  • Right to know: If the personal data is obtained directly from the data subject, you have the right to ask BM-Switch.com to provide the following information:

The identity and contact details of the data controller and the identity and contact details of the representative of the data controller;

Contact details of the DPO;

Purposes of processing and legal basis for processing;

  • Right to object/opt-out: You can exercise the right to object when personal data is processed based on your consent, public interest, or legitimate interests of BM-Switch.com.

  • Right to know: BM-Switch.com is obliged to notify individuals of the items stipulated in APP 5.2 when or before collecting the information. If this is impracticable, notification must be made as soon as possible after this information is collected. The notice includes who is collecting, the purpose of collection, what the information will be used for, and to whom it may be disclosed.
  • Access right: the right to access personal information held by BM-Switch.com.
  • Right to correction: the right to request correction of personal information held by BM-Switch.com.

Any personal information provided to or collected by BM-Switch.com is primarily controlled by BM-Switch.com.

  • Use of Personal Information

BM-Switch.com and its subsidiaries and other entities around the world that abide by this Privacy Policy or at least implement the practices described in this Privacy Policy as a safeguard. Your personal information will be jointly used for the purposes described in this Privacy Policy. Commonly used personal information includes the personal information described in “Personal Information We Collect” and “Examples of Collected Information” in this Privacy Policy. BM-Switch.com is the operator mainly responsible for the management of shared personal information.
We will share personal information with third parties, but only within the scope described in “Disclosure of Personal Information to Third Parties”, and will operate in accordance with the Protection of Personal Information Act.

  • Right to correction: You have the right to ask BM-Switch.com to correct any inaccurate data controlled by BM-Switch.com, except for the exceptions in Schedule VI of the PDPA. If BM-Switch.com has reasonable grounds to believe that the correction should not be made, the request for correction cannot be made.
  • Right to object/opt-out: You have the right to withdraw your consent to the collection, use or disclosure of your personal data by BM-Switch.com at any time. However, the withdrawal of consent does not affect any legal consequences arising from the withdrawal.
  • Right to data portability: You can file a data portability request with the porting organization. After receiving the data porting request, BM-Switch.com transmits the data specified in the data porting request to the receiving organization.
